I. INFORMATIONS GENERALES

1. Lieu de la consultation : Niger (Niamey avec possibilité de la tenue de l’une des sessions de formation à Tillaberi, Tahoua ou Diffa). Le Travail sera fait en collaboration avec l’équipe du Programme de ABA ROLI basée à Niamey, notamment la chargée de programme sur les droits humains.
2. Intitulé : « Mission de consultation pour la formation des commissaires et personnel technique de la CNDH du Niger sur les techniques d’enquêtes et d’investigations de graves violations des droits humains en situation de crise sécuritaire et d’accompagnement des victimes dans leur quête de justice ».
3. Période d’exécution : 45 jours (allant du 11 Avril au 6 juin 2022) dont 15 jours de travail au Niger (du 2 au 20 Mai 2022). Cette période pourrait être revue de commun accord avec le (la) Consultant(e) qui sera recruté (e).
   II. A PROPOS DE L’ORGANISATION ET DU PROJET DHAJ

Association du Barreau Américain Initiative pour l’Etat de Droit (ABA ROLI)
L’initiative pour l’État de droit est un projet de service public de l’Association du Barreau Américain qui vise à promouvoir les efforts de réforme juridique dans plus de 40 pays du monde. L’Initiative pour l’Etat de droit concentre ses efforts d’assistance juridique technique dans les domaines suivants : 1) Lutte contre la corruption et l’intégrité publique ; 2) Droit pénal et lutte contre la traite des personnes ; 3) Questions de genre ; 4) Droits de l’homme et atténuation des conflits ; 5) Réforme judiciaire ; 6) Réforme de l’enseignement juridique ; et 7) Réforme de la profession juridique. L’initiative pour l’”État de droit” fait appel à des personnes disposant de compétences et de l’engagement nécessaires pour promouvoir efficacement l’État de droit dans nos pays d’accueil.
Projet « Droits Humains et Accès à la Justice au Niger (Projet Adalci) »
Search for Common Ground (Search), en étroite collaboration avec l’American Bar Association (ABA) et Pact, met en œuvre un projet de consortium de quatre ans allant du 15 septembre 2020 au 14 septembre 2024 financé par Freedom House par le biais du mécanisme de soutien aux droits de l’homme financé par l’Agence des États-Unis pour le développement international (USAID).
Le but du projet “Adalci” (équité) est de contribuer à renforcer les voies de la justice pour réduire la vulnérabilité à l’extrémisme violent (VE) en améliorant les outils permettant de traiter les griefs fondamentaux qui alimentent l’extrémisme dans les trois principaux foyers d’instabilité du pays : Diffa, Tahoua, et Tillabéri.
Pour réaliser ce but, le projet s’articule autour de trois objectifs spécifiques :
L’objectif 1 Amélioration de la capacité des mécanismes coutumiers et autres mécanismes locaux de médiation des conflits dans les zones cibles sujettes aux VE pour traiter les griefs et résoudre les différends.
L’objectif 2 Les populations des zones sujettes aux VE sont habilitées à naviguer et à accéder au système judiciaire formel pour résoudre leurs différends ou faire valoir leurs droits.
L’objectif 3 Le gouvernement du Niger et les organisations de la société civile (OSC) disposent d’une capacité accrue pour faire face aux violations des droits de l’homme liées à la VE et commises par des acteurs étatiques et non étatiques.
Les activités soutenant l’objectif 3 favoriseront la collaboration entre les OSC, les acteurs de la justice et les autorités compétentes, en particulier la Commission nationale des droits de l’homme (CNDH), afin d’améliorer les relations par le biais d’un plaidoyer de terrain d’entente et d’encourager le gouvernement à soutenir une plus grande responsabilisation des acteurs officiels de la sécurité et de la justice. Cela permettra d’améliorer et d’étendre les efforts d’enquête et de traitement des violations des droits de l’homme liées à la VE dans les régions ciblées, en soulevant les questions pertinentes émergeant de l’engagement détaillé dans les objectifs 1 et 2. Les activités utiliseront des modèles de collaboration pour rechercher des solutions aux problèmes collectifs par le biais d’incitations et de relations et réseaux renforcés.
La présente consultation s’inscrit dans le cadre de la mise en œuvre des activités de formation des commissaires et le personnel technique de la CNDH prévues par l’objectifs 3 du Projet Adalci. Le Consultant e travaillera en étroite collaboration avec la chargée de programme en droits humains du projet Adalci.
(III) OBJECTIFS DE LA CONSULTATION
L’objectif global de la consultation est de renforcer les capacités des commissaires et le personnel technique de la CNDH dans la conduite des enquêtes et investigations sur les graves violations des droits humains en situation de crise sécuritaire et l’accompagnement des victimes dans leur quête de justice ainsi qu’un renforcement de capacité sur les techniques d’élaboration de rapport de qualité et sur le plaidoyer et le lobbiying. Ces mêmes formations seront aussi délivrées aux staffs techniques des OSCs sélectionner sur le projet.

Les objectifs spécifiques de la consultation sont de sensibiliser la CNDH sur la portée et l’étendue de son de son mandat légal et les OSC sur leur rôle de chien de garde de la société, dans le but d’améliorer la qualité et l’impact du contenu de leurs rapports.
Les formations couvriront les éléments suivants :

• Techniques d’enquête et constitution de dossiers sur les violations des droits humains, y compris en période de crise sécuritaire ;
• Rôle des Institutions Nationales des Droits de l’Homme (INDH) en matière de traitement des violations des droits humains, y compris la saisine des instances internationales et des acteurs nationaux notamment en ce qui concerne les résultats des enquêtes ;
• Mécanismes de collaboration entre les juridictions internationales, y compris la CPI, et le Niger en matière d’enquêtes sur les auteurs présumés de crimes internationaux ;
• Usage de la technologie de l’information dans la documentation et la conservation des témoignages et autres preuves de violations des droits humains ;
• Techniques de protection des victimes et témoins de graves violations des droits humains ;
• Enquêtes et investigations spécifiques concernant les cas de violences sexuelles ;
• Sécurisation des enquêtes et des investigations ;
• Techniques de plaidoyer et de lobbying ;
• Techniques de collecte d’informations fiables à l’ère des « fakes news » sur les cas de violations des droits humains ;
• Organisation de l’information contenue dans un rapport ;
• Technique de documentation et de rédaction de rapport.
• Organiser des sessions de formation en matière de droits de l’homme et de droit international en mettant l’accent sur des sujets ayant un impact plus important dans le contexte nigérien.

Les protocoles à élaborer porteront sur la protection des victimes et témoins, dont l’un à l’usage de la CNDH, et l’autre à l’usage des OSC tenant des cliniques juridiques qui assurent l’assistance judiciaire des victimes de graves violations des droits humains. L’élaboration de ces protocoles se fera avec l’implication des utilisateurs. ABA ROLI facilitera, à travers sa chargée de programme en Droits Humain, l’interaction entre le Consultant (e), la CNDH et les OSC cibles.

(IV) PROFIL DES BENEFICAIRES
Les sessions de formations (quatre) que le (la) Consultant (e) est appelé (e) à assurer bénéficieront à deux catégories d’acteurs :
• Les membres (commissaires) et personnel technique de la CNDH ; et
• Les membres des OSC
Les deux catégories de bénéficiaires ci-dessus seront formées séparément.
(V) PRINCIPALES RESPONSABILITES DU (DE LA) CONSULTANT(E)

1) Concevoir et développer des modules de formation couvrant les objectifs spécifiques ci-dessus, adaptés aux deux catégories de bénéficiaires ;
2) Proposer un agenda pour chaque session de formation (CNDH et OSC) ;

3) Rédiger un rapport de mission incluant des observations et des recommandations sur la mission effectuée, notamment sur la méthodologie appliquée et sur l’évaluation des résultats obtenus.

(VI) MODULES DE FORMATION : ARTICULATION ET CONTENU

Chacun des modules devra être structuré de sorte à faire ressortir les éléments ci-après :

1) Titre du module : Il doit être conçu et proposé de sorte à être tout à la fois concis et le plus représentatif du contenu.
2) Objectifs pédagogiques du module : Ils doivent être définis avec clarté pour :
• permettre une référence objective lors de l’évaluation par le consultant lui-même et par ABA- ROLI de leur atteinte ;
• orienter le découpage de la formation en sessions et en activités ;
• informer (savoir) et engager (savoir-faire) en connaissance de cause les bénéficiaires de la formation.
Le(la) consultant(e) peut notamment classer ces objectifs par catégorie, selon qu’ils sont (i) cognitifs (savoir ou connaissance – domaine de la pensée) ; (ii) psychomoteurs (savoir-faire ou aptitude technique) ou (iii) affectifs (savoir-être ou comportement).
Le(la) consultant(e) indiquera entre autres les compétences visées dans le cadre de chaque module.
3) Aperçu général du contenu : Au sens de la présente consultation, un aperçu s’entend d’un survol indicatif et explicatif des principales connaissances théoriques et des débats d’école en cours sur les sujets de formation. Un aperçu s’étend au-delà d’une liste à puces ou d’un simple énoncé de ces sujets. Il introduit brièvement la matière et fait ressortir les points les plus essentiels de connaissance et de débat.
4) Contenu du module : Il comprend le développement des points retenus pour chaque module, avec indication des sources.
5) Supports pédagogiques : Le(la) consultant(e) inventorie et classifie la documentation recommandée aux apprenant(e)s (notamment les instruments juridiques auxquels il est fait référence dans chaque module), y compris les études de cas qu’il (elle) propose en annexe de chaque module. Il(elle) fera un énoncé brièvement expliqué de la liste du matériel à prévoir et décrira l’enchaînement ou l’ordre de séquence des activités proposées.
6) Type d’évaluation : Pour chaque module, le(la) consultant(e) propose et justifie une forme ou un procédé d’évaluation des progrès enregistrés par les apprenants (e)s par rapport aux objectifs pédagogiques.

Chaque module de formation est limité à 15 pages au maximum, annexes non inclues.

(VII) DELIVRABLES ATTENDUS

1) Les termes de référence pour chaque session de formation, à élaborer avec l’équipe du projet Adalci, comprenant un agenda de chaque session.
2) Les modules conçus pour chacune des deux sessions de formation.
3) Un manuel ou cahier du participant contenant l’ensemble des documents utiles pour référence après la formation.
4) Un protocole sur la protection des victimes et témoins à l’utilisation de la CNDH.
5) Un protocole sur la protection des victimes et témoins, à l’utilisation des organisations de la société civile tenant des cliniques juridiques qui assurent l’assistance judiciaire des victimes de graves violations des droits humains.

(VIII) PROFIL DU (DE LA) CONSULTANT(E)

1) Qualifications et expérience professionnelle

• Titulaire dun diplôme universitaire supérieur en droit, avec un minimum de 7 ans dexpérience dans la thématique abordée par les formations à assurer.
• Très bonne connaissance écrite et orale du Français.
• Lire et comprendre l’Anglais en plus représenterait un avantage.
• Bonne connaissance et manipulation de l’outil informatique (Microsoft Office, Internet).
• Expérience confirmée comme formateur (trice) ou animateur(trice) de formation pour adultes avec des méthodes participatives.
• Expérience confirmée en matière d’analyse contextuelle, de conception/rédaction et de synthèse.
• Bonne connaissance du contexte actuel dans le Sahel.
• Expérience professionnelle en tant que chercheur ou consultant pour rédiger des analyses ou recherches/études en Afrique de l’Ouest.
• Connaissance des enjeux sur les violations des droits humains au Niger.
• Expérience avec les OSC et la méthodologie participative souhaitable.
• Expérience en tant que formateur sur les thématiques mentionnées au point (III) ci-dessus.
• Toute expertise supplémentaire pertinente sera valorisée.
2) Compétences et qualités :

• Autonomie, intégrité, sens des responsabilités, sens des priorités, faculté de travailler en équipe multiculturelle, proactivité, esprit d’initiative, attitude d’écoute.

TERMS OF REFERENCE FOR A CONSULTANT RESPONSIBLE FOR TRAINING COMMISSIONERS, TECHNICAL STAFF AND SENIOR STAFF OF THE NATIONAL HUMAN RIGHTS COMMISSION (CNDH) OF NIGER AND CSOS ON TECHNIQUES FOR RESEARCHING AND INVESTIGATING SERIOUS HUMAN RIGHTS VIOLATIONS AND ACCOMPANYING VICTIMS IN THEIR QUEST FOR JUSTICE

III. GENERAL INFORMATION

1. Consulting location: Niger (Niamey with the possibility of holding one of the training sessions in Tillaberi, Tahoua or Diffa). The work will be performed in collaboration with the ABA ROLI Program team based in Niamey, including the Human Rights Program Officer.
2. Title: “Consultation mission for the training of commissioners and technical staff of the CNDH of Niger on techniques of research and investigation of serious human rights violations in security crisis situations and of accompanying victims in their quest for justice.”
3. Execution period: 45 days (from April 11 to June 6, 2022) including 15 working days in Niger (from May 2 to 20, 2022). This period may be reviewed by mutual agreement with the Consultant to be recruited.
   IV. ABOUT THE ORGANIZATION AND THE DHAJ PROJECT

American Bar Association Initiative for the Rule of Law (ABA ROLI)
The Rule of Law Initiative is a public service project of the American Bar Association that aims to promote legal reform efforts in more than 40 countries around the world. The Rule of Law Initiative focuses its technical legal assistance efforts in the following areas: 1) Fighting Corruption and supporting Public Integrity; 2) Criminal Law and Combating Trafficking in Persons; 3) Gender Issues; 4) Human Rights and Conflict Mitigation; 5) Judicial Reform; 6) Legal Education Reform; and 7) Legal Profession Reform. The “Rule of Law” initiative calls on people with the skills and commitment to effectively promote the rule of law in our host countries.
Project “Human Rights and Access to Justice in Niger (Adalci Project)”
Search for Common Ground (Search), in close collaboration with the American Bar Association (ABA) and Pact, is implementing a four-year consortium project from September 15, 2020 to September 14, 2024 funded by Freedom House through the Human Rights Support Mechanism funded by the United States Agency for International Development (USAID).
The purpose of the “Adalci” (equity) project is to contribute to strengthening justice pathways to reduce vulnerability to violent extremism (VE) by improving tools to address the fundamental grievances that fuel extremism in the country’s three main hotbeds of instability: Diffa, Tahoua, and Tillabéri.
To achieve this goal, the project is structured around three specific objectives:
Goal 1 Enhanced capacity of customary and other local conflict mediation mechanisms in target areas prone to EVs to address grievances and resolve disputes.
Goal 2 People in EV-prone areas are empowered to navigate and access the formal justice system to resolve their differences or assert their rights.
Goal 3 The government of Niger and civil society organizations (CSOs) have increased capacity to address VE-related human rights violations committed by state and non-state actors.
Activities supporting Goal 3 will foster collaboration among CSOs, justice actors and relevant authorities, in particular the National Human Rights Commission (CNDH), to improve relations through common ground advocacy and encourage the government to support greater accountability of official actors in security and justice. This will improve and expand efforts to investigate and address VE-related human rights violations in targeted regions, raising relevant issues emerging from the engagement detailed in Goals 1 and 2. Activities will use collaborative models to seek solutions to collective problems through incentives and strengthened relationships and networks.
This consultation is part of the implementation of the training activities for commissioners and technical staff of the CNDH provided for in Objective 3 of the Adalci Project. The Consultant will work closely with the human rights program officer of the Adalci project.
(III) OBJECTIVES OF CONSULTATION
The overall objective of consulting is to strengthen the CNDH commissioners and technical staff’s capacities in conducting research and investigations into serious human rights violations in security crisis situations and to support victims in their quest for justice as well as to strengthen capacity in quality reporting techniques, advocacy and lobbying. These same training courses will also be delivered to the technical staff of the CSOs selected on the project.

The specific objectives of consulting are to raise awareness of the CNDH on the scope and extent of its legal mandate and CSOs on their role as watchdogs of society, with the aim of improving the quality and impact of their report content.
Training will cover the following:

• Investigative techniques and documentation of human rights violations, including in times of security crisis;
• The role of National Human Rights Institutions (NHRIs) in dealing with human rights violations, including referral to international bodies and national actors, particularly with regard to the results of investigations;
• Mechanisms for collaboration among international jurisdictions, including the ICC, and Niger in the investigation of alleged perpetrators of international crimes;
• Use of information technology in documenting and preserving testimonies and other evidence of human rights violations;
• Techniques for protection of victims and witnesses of serious human rights violations;
• Specific research and investigations into cases of sexual violence;
• Securing research and investigations;
• Advocacy and lobbying techniques;
• Techniques for gathering reliable information on cases of human rights violations in the era of “fake news;”
• Organization of the information contained in a report;
• Documentation and report writing technique.
• Organize training sessions on human rights and international law with a focus on topics that have a greater impact in the Nigerien context.

Protocols to be drawn up will deal with the protection of victims and witnesses, one for the use of the CNDH, and the other for the use of CSOs running legal clinics that provide legal assistance to victims of serious human rights violations. Users will be involved in developing these protocols. ABA ROLI will facilitate, through its Human Rights Program Officer, the interaction between the Consultant, the CNDH and the target CSOs.

(X) PROFILE OF BENEFICIARIES
The training sessions (four) that the Consultant is called upon to provide will benefit two categories of actors:
• CNDH members (commissioners) and technical staff; and
• CSO members
The above two categories of beneficiaries will be trained separately.
(XI) MAIN RESPONSIBILITIES OF CONSULTANT

1) Design and develop training modules covering the specific objectives above, adapted to both categories of beneficiaries;
2) Propose an agenda for each training session (CNDH and CSO);

3) Write a mission report including observations and recommendations on the mission conducted, in particular on the methodology applied and on the evaluation of the results obtained.

(XII) TRAINING MODULES: STRUCTURE AND CONTENT

Each module should be structured to bring out the following elements:

7) Module title: It must be designed and offered in a way that is both concise and the most representative of the content.
8) Educational objectives of module: They must be clearly defined to:
• allow an objective reference for achievement during the evaluation both by the consultant and by ABA-ROLI;
• guide the division of training into sessions and activities;
• inform (know) and engage (know-how) knowingly the beneficiaries of the training.
In particular, the consultant may classify these objectives by category, according to whether they are (i) cognitive (expertise or knowledge – field of thought); (ii) psychomotor (technical know-how or aptitude) or (iii) emotional (soft skills or behavior).
Among other things, the consultant will indicate the competencies targeted within each module.
9) General content overview: For the purpose of this consultation, an overview is understood to be an indicative and explanatory summary of the main theoretical knowledge and ongoing school debates on training topics. An overview extends beyond a bulleted list or a simple statement of these topics. Briefly introduce the subject and highlight the most essential points of knowledge and debate.
10) Module content: It includes the development of the points retained for each module, with indication of the sources.
11) Teaching materials: The consultant inventories and classifies the documentation recommended to learners (including the legal instruments referred to in each module), including the case studies that he or she proposes as an appendix to each module. He/she will make a briefly explained statement of the list of equipment to be provided and describe the order or sequence of proposed activities.
12) Evaluation type: For each module, the consultant proposes and justifies a form or method of evaluating the learners’ progress toward the training objectives.

Each training module is limited to a maximum of 15 pages, appendices not included.

(XIII) DELIVERABLES EXPECTED

6) Terms of reference for each training session, to be developed with the Adalci project team, including an agenda for each session.
7) Modules designed for each of the two training sessions.
8) A participant’s manual or notebook containing all the useful documents for reference after the training.
9) A protocol on the protection of victims and witnesses for CNDH use.
10) A protocol on the protection of victims and witnesses, for the use of civil society organizations holding legal clinics that provide legal assistance to victims of serious human rights violations.

(XIV) CONSULTANT PROFILE

3) Qualifications and work experience

• Holder of a higher university degree in law, with a minimum of 7 years of experience in the subject addressed by the courses to be provided.
• Very good written and oral knowledge of French.
• Reading and understanding English would also be an advantage.
• Good knowledge and handling of computer tools (Microsoft Office, Internet).
• Proven experience as an adult training trainer or facilitator with participatory methods.
• Proven experience in contextual analysis, design/writing and synthesis.
• Good knowledge of the current context in the Sahel.
• Professional experience as a researcher or consultant writing analyses or research/studies in West Africa.
• Knowledge of the issues surrounding human rights violations in Niger.
• Experience with CSOs and participatory methodology desirable.
• Experience as a trainer on the topics mentioned in point (III) above.
• Any additional relevant expertise will be valued.
4) Skills and qualities:

• Autonomy, integrity, sense of responsibility, sense of priorities, ability to work in a multicultural team, proactivity, initiative, listening attitude.

  SELECTION CRITERIA
  Offers will be studied according to the following criteria:

• Quality of the technical offer: relevance of the proposed methodology in relation to ABA ROLI’s expectations detailed above.
• Quality of the financial offer: realism of the proposed costs, coherence between the budget and the methodological offer.
