About the position:
GHAI seeks a consultant to support a review and reform of the legal framework for the Civil Registration, Vital Statistics and ID Management (CRVSID) system in Tunisia. This involves an analysis of the CRVSID legal framework and system, using a toolkit, to identify gaps, bottlenecks and obstacles to a well-functioning and integrated CRVSID system, followed by recommendations on how the relevant legal documents (laws, regulations, guidelines, SOPs, etc.) can be reformed, amended or created anew to better align with international best practices. The consultant will then work with and assist government officials in taking the legal reform process forward, according to the priorities of the government, including providing technical assistance in drafting relevant legal instruments where required.
The consultant will work in close coordination with government officials and Data for Health partner organizations to improve CRVSID systems in Tunisia.
Training and supervision on the CRVSID best practice, use of the toolkit, and the legal review process will be provided to the consultant.
About the Data for Health Program
GHAI is part of the Bloomberg Philanthropies Data for Health (D4H) Initiative, which supports low- and middle-income countries in Africa, Latin America, and Asia and the Pacific to improve civil registration, vital statistics and identity management (CRVSID) systems. Civil registration systems are the systems that register births, deaths, foetal deaths, and other vital events. Civil registration data is used to produce vital statistics, which are essential for government planning and policymaking, and birth and death registration create and retire an individual’s legal identity.
About the CRVSID legal review and reform process
Legal Review
The legal review process involves collecting all existing legal instruments (laws, regulations, rules procedures, guidelines, SOPs, etc.) pertaining to CRVSID in Tunisia and analyzing them against international best practices to identify gaps, bottlenecks and obstacles to a well-functioning and integrated CRVSID system. This is followed by recommendations on how the relevant legal instruments can be reformed, amended or created anew to better align with best practices.
A CRVSID legal review is completed using the Data for Health (D4H) CRVSID Legal and Regulatory Review Toolkit (the “Toolkit”), which is both a teaching tool and an interactive document, made up of 13 chapters, used to guide the legal consultant through a step-by-step, carefully guided process of reviewing the relevant laws.
The Toolkit analysis is then used to draft a recommendations report, which will outline key recommendations to strengthen the CRVSID systems in Tunisia. This report will be presented to all government stakeholders involved in CRVSID by the legal consultant during a Recommendations Report Workshop.
Legal Reform
The legal reform process follows on from the legal review and requires the legal consultant to engage decision makers in the relevant agencies and government departments to develop an action plan for reform based on the recommendations and government priorities, and then to take steps to progress the reforms through to adoption.
The Legal consultant will provide technical assistance to the relevant government or parliamentary agency to ensure the amendments to the legal framework are consistent with the agreed policy and procedural priorities, and may be required to provide technical assistance on drafting laws, regulations, SOPs and guidelines, as required, to ensure the legal reforms are comprehensive and in line with best practices.
The legal consultant will build and maintain relations with key governmental officials, political leaders and Data for Health partner organizations and use those relations to develop and implement advocacy strategies related to ensuring the recommendations and policy priorities resulting from the legal review are adopted and implemented.
Where appropriate, the legal consultant will coordinate with and support Civil Society Organization (CSOs) grantees on advocacy strategies to seek government prioritization for legal reform and budget allocation for strong, universal CRVSID systems.
Duration and basis of consultancy
The consultancy will initially be for 12 months from approximately 1 March 2024 to 28 February 2025.
Additional work may be agreed upon after the initial consultancy period, depending on the stage at which the legal review and reform project has reached and upon agreement with the Tunisian government and Data for Health partner organization as to the further work required.
